A Qualified Medical Child Support Order (QMCSO) requires health insurers to enroll a child or adopted child in the Participant’s Group Health Plan.
The QMCSO provisions apply to “group health plans” subject to the Employee Retirement Income Security Act (ERISA). ERISA does not apply to Federal, State or Municipal plans, but those plans must comply with National Medical Support Notices, which is issued by a State child support enforcement agency.
The QMCSO requires that the child/Alternate Recipient be enrolled in any health coverage available under the plan immediately upon receipt of the Order and for as long as eligible under the terms of the plan, with the Custodial Parent permitted to file claims.
